WALMART CALIFORNIA BLACK FRIDAY SECURITY GUARDS SETTLEMENT

YOU MAY BE ENTITLED TO MONEY FROM A CLASS ACTION SETTLEMENT IF YOU WORKED FOR U.S. SECURITY ASSOCIATES STAFFING, INC. (“USSAS”), OR THROUGH A SUBCONTRACTOR THAT PROVIDED WORKERS TO USSAS, AS A SECURITY GUARD/OFFICER OR CROWD CONTROL WORKER AT A WAL-MART BLACK FRIDAY EVENT IN CALIFORNIA IN 2011, 2012, 2013, 2014 OR 2015.

In a lawsuit titled, Harris v. U.S. Security Associates, Inc., et al. Case No. 37-2015-00014759-CU-OE-CTL, pending in California Superior Court for the County of San Diego (“Harris Action”), the plaintiffs Fernando Harris, Heladio Ortega Diaz and William Odell (“Plaintiffs”) allege that U.S. Security Associates, Inc., U.S. Security Associates Staffing, Inc. (“USSAS”) (collectively “U.S. Security”), and Wal-Mart Stores, Inc. (“Wal-Mart”) failed to provide security guards/officers and crowd control workers at Wal-Mart Black Friday Events required breaks, overtime and minimum wages, accurate wage statements, and reimbursement for certain expenses, and owe damages or penalties as a result. 

U.S. Security and Wal-Mart deny these claims and maintain they paid all workers properly and deny Plaintiffs are entitled to any of the money they seek.

A class action is a lawsuit in which an individual called a “Class Representative” brings a single lawsuit on behalf of other people who have similar claims. All of these people together are a “Class” or “Class Members.” Once a Class is certified, a class action Settlement finally approved by the Court resolves the issues for all Settlement Class Members, except for those who exclude themselves from the Settlement Class.

 

WHAT ARE MY OPTIONS?

 

(1) File a Claim Form.

In order to receive a payment from this Settlement, you must file a Claim form by February 22, 2019. You may obtain a Claim Form by clicking here or by calling the Claims Administrator and you may submit your Claim Form online by clicking here or by U.S. Mail to: WALMART CALIFORNIA BLACK FRIDAY SECURITY GUARDS SETTLEMENT, Claims Administrator, P.O. Box 404000, Louisville, KY 40233-4000.  After you submit a valid Claim Form, and after final approval by the Court, your payment will be mailed to you at the same address as listed in the Notice you received.  If your address has changed, please notify the Claims Administrator in writing or by calling 1-866-580-1716.  Mailed Claim Forms must be postmarked by February 22, 2019.

 

(2) Exclude yourself.

If you do not want to be a member of the Settlement Class, you must exclude yourself by sending a completed and signed Request for Exclusion stating that you want to be excluded from the Settlement in Harris v. U.S. Security Associates, Inc., No. 37-2015-00014759-CU-OE-CTL.  The Request for Exclusion must include a written statement requesting exclusion from the Settlement, your name, address, telephone number, valid signature, and last four digits of your social security number to the Claims Administrator by U.S. Mail to: WALMART CALIFORNIA BLACK FRIDAY SECURITY GUARDS SETTLEMENT, Claims Administrator, P.O. Box 404000, Louisville, KY 40233-4000,  postmarked no later than February 22, 2019.

If you request exclusion from the Settlement Class, you will receive no money or benefit from the Settlement, but you will retain the ability to sue U.S. Security Associates, Inc., USSAS, subcontractors who supplied workers to USSAS for Black Friday Events, and Wal-Mart Stores, Inc. for the claims or legal theories asserted in this Action in a different lawsuit. 

 

(3) Object to the Settlement.

If you are a member of the Settlement Class, you can object to any part of the Settlement.  The Court will consider your views.  To object, you must submit a letter that includes the following:

You must mail your objection to the Claims Administrator by U.S. Mail to: WALMART CALIFORNIA BLACK FRIDAY SECURITY GUARDS SETTLEMENT, Claims Administrator, P.O. Box 404000, Louisville, KY 40233-4000, postmarked by February 22, 2019 or it will not be considered.

 

(4) Do Nothing.

If you do nothing, you will not receive any share of the Settlement; however, you will still be bound by the release of claims in the Settlement, which means that you will not be able to sue U.S. Security Associates, Inc., USSAS, subcontractors who supplied workers to USSAS for Black Friday Events, or Wal-Mart Stores, Inc. for any of the claims or legal theories asserted in the Harris Action.
